Privacy Policy

Principles on the protection of Personal Data  
(hereinafter 'Privacy Policy') 

This document also covers the processing of personal data and our cookie policy. 

1. Controller of Personal Data 

Controller is any legal entity that is a part of the Photon Energy Group – a group of legal unities under a joint control of Photon Energy N.V., with registered seat Barbara Strozzilaan 201, Amsterdam 1083 HN, the Netherlands, registered with the Commercial registry maintained by the Dutch Chamber of Commerce (Kamer van Koophandel), corporate number: 51447126, VAT number: NL850020827B01 (as a parent company) (hereinafter the ‘Controller’ or ‘We’). The Controller provides services connected with solar energy and water treatment and in the course of its activities administrates its website www.photonenergy.com or www.lerta.energy (hereinafter ‘Website’).  

2. Processing of Personal Data 

Within the meaning of Regulation (EU) 2016/679 Of The European Parliament And Of The Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter ‘Regulation’), in the course of our business,  we process personal data of visitors of the Website and we process personal data of physical persons for marketing, sales and recruitment purposes (the visitors or other physical persons hereinafter ‘User’ or ‘Users’ or “You”). We are part of a group of undertakings or institutions affiliated to a central body (Photon Energy N.V.) that may have a legitimate interest in transmitting Personal Data (as defined below) within the group of undertakings for internal administrative purposes as presumed by preamble no. 48 of the Regulation.  

In the meaning of the Regulation personal data means any information relating to an identified or identifiable natural person (hereinafter „Personal Data“). Personal Data can be processed with Your consent or without it. 

We process the Personal Data as a controller. Personal Data may be in some cases processed by another processor based on a contractual relationship between Us and such processor. We can provide You with their list at Your request. 

We process your Personal Data on the basis of the legal grounds listed below: 

  • processing is necessary for the performance of a contract to which You are a party 
  • processing is necessary for compliance with a legal obligation to which We are a subject 
  • processing is necessary for the purposes of the legitimate interests pursued by us (e.g. court dispute or pursuing an insurance claim), the scope of Personal Data is restricted to the Personal Data, which are necessary for the successful claim 
  • processing is necessary for the performance of a task carried out in the public interest 
  • Your explicit consent  

3. Processing of Personal Data from Our Website 

We process the following Personal Data from the Website: 

  • IP address 
  • Viewed pages 
  • Date and time of viewing 
  • Referrer URL 
  • Language setting 
  • Geographical location 

With every visit to our Website, usage data is transmitted through the respective web browser and is stored in log files. 

Personal Data will be anonymized and used for statistical purposes to improve the Website and to protect servers from abuse by third parties which is our legitimate interest according to Article 6 para 1 letter f) of the Regulation. 

We process Personal Data from Website on an automated basis; We do not use profiling. Automated processing means processing of Personal Data, where automated information systems are used exclusively, e.g. IT applications, software etc. 

4. Processing of Personal Data for Marketing Purposes 

We further process following Personal Data for marketing purposes: 

  • Name and surname 
  • E-mail 
  • Home address 
  • Phone number 

Marketing includes mainly offer of products or services of Photon Energy Group. On the basis of your consent we can send You offers electronically, preferably by e-mail. You can always request to cancel receiving the offers (opt out). 

Personal Data for marketing purposes are not processed on an automated basis. 

5. Processing of Personal Data for Sales Purposes 

Based on your consent and request, we process the following Personal Data for the purpose of preparing a non-binding offer to You for an installation of home PV systems. 

  • Name and surname 
  • E-mail 
  • Home address 
  • Phone number 

Personal Data for this purpose are not processed on an automated basis.  

6. Processing of Personal Data for Recruitment Purposes 

  • Your personal data  
  • Name and surname 
  • E-mail 
  • Home address 
  • Phone number 
  • Information about Your professional experience 
  • Information about Your education and interests 

shall be processed in order to carry out the recruitment process, conclude an employment contract, or future recruitment (if additional consent is provided for this purpose). You grant your consent to processing data (a) by providing personal data (your CV) through application on the careers section at www.photonenergy.com, (b) by sending your CV to careers@photonenergy.com, info@photonenergy.com, info@photonenergy.cz or any other email address the Company may have from time to time, (c) by providing your CV through a personal referral. 

You may, at any time, withdraw your consent, however, withdrawing your consent shall not affect the lawfulness of processing based on consent before its withdrawal. Your personal data will be processed until possible withdrawal of consent for processing, however, not longer than 18 months after the conclusion of the recruitment process (based on the legitimate interest of the Company to pursue claims or defend itselft against potential claims). If you grant additional approval for future recruitment, your data will be processed for 2 years.   

7. Transfers of Personal Data to Third Parties 

When processing the Personal Data, there shall be no unauthorized transfer of Personal Data to third countries or international organizations (with exclusions below). Collected Personal Data are transferred solely within Photon Energy Group or (in case of our legal obligation) to public (governmental) authorities and institutions, or to our service providers which act as processors of Personal Data under the Regulation. 

We implement appropriate technical and organisational measures to avoid unauthorized or incidental access to Your Personal Data, their change, destruction or loss, unauthorized transfer or processing, or any other abuse. 

8. Processing Time of Personal Data 

Unless the processing time is specified, Personal Data in connection to the Website are processed for the necessary time in order to achieve a given objective. When the law does not determine a specific data storage period, We independently determine the retention period bearing in mind the principles of proportionality and accountability.  

If We process the Personal Data based on your consent, we process your Personal Data until you withdraw such consent and request cancellation of this processing (opt out).   

9. Rights Related to Processing of Personal Data 

You have the right to request the following rights. You have the right to:

  • Personal Data portability (the right to receive the Personal Data, which You have provided)

You are allowed to claim the above mentioned by writing to the registered seat of the Controller or by e-mail to privacy@photonenergy.com. We will respond to You or provide You with the information about taken measures as soon as possible after Your request was received. 

If you believe that your rights under the Regulation have been violated as a result of the processing of Personal Data by us, You also have the right to file a complaint with the relevant Office for the Protection of Personal Data or in case of Australia, the Office of the Australian Information Commissioner. 

10. Use of Cookies 

We use cookies to optimize our Website. A cookie is a text file that is either temporarily stored in the computer memory (hereinafter ‘session cookie’) or stored on the hard disk (hereinafter ‘persistent cookie’). Cookies contain information about previous visits by the User on the server or information which pages or services have been visited by the User. Cookies are used to identify the Users’ computer as they use a network. Specific cookies are used to improve their web browsing experience. You always have the option to refuse the setting of non-technical (non-essential) cookies. This is usually done by selecting the appropriate option in Your browser settings. 11. Use of Google Analytics 

This Website uses Google Analytics, a web analytics service provided by Google, Inc. (hereinafter ‘Google’) to gain insights and improve the functionality of Our website, or to collect data for marketing purposes. The information generated by the cookie about Your use of the Website (including Your IP address) may be transmitted to and stored by Google on servers outside the European Union. Google Analytics operates data centers globally, including in the United States, to maximize service speed and reliability. Before data is transferred to any servers in the United States, it is collected in local servers, where users’ IP addresses are anonymized (when the feature is enabled by customers). You may opt out and refuse the use of analytical cookies.  

In addition, We may use Google Signals. Google signals are session data from sites and apps that Google associates with users who have signed into their Google accounts, and who have turned on Ad Personalization. This association of data with these signed-in users is used to enable cross-device reporting, cross-device remarketing, more information can be found here.  

12. Changes of Privacy Policy 

We are allowed to change or amend this Privacy Policy, the change is effective by its publication on the Website of the Controller.

Despite the utmost care in preparing the Website, we do not warrant the accuracy, completeness and actuality of the content provided. The use of the contents of the Website is at Your own risk. The use of the Website does not create any contractual relationship between the User and any entity of the Photon Energy Group.

If the Website contains links to third party websites (hereinafter ‘external links’), the content of these websites is subject of the liability of the respective operator. At the time of linking, no violations of laws or third party rights were found by us. We have no influence on current and future design and content of the linked pages. In any case, no content of the linked pages shall be understood as statements, offers or advertisement of the Photon Energy Group or in any other way as content of this Website. Once we become aware of violations in the linked sites, these links will be deleted immediately. 

Intellectual Property Law, Copyright and Rights related to Copyright 

The contents published on the Website are protected by copyright or any other Intellectual Property law. Each use of the contents and information on the Website which is not allowed shall require the prior written approval of Photon Energy N.V. or respective owners of the copyright.
